What are the Legal Bases for processing Personal Data

Who is the competent data protection authority?
You have the right to complain about our processing of Personal Data to a supervisory authority responsible for data protection. The supervisory authority in Germany on federal level is the Federal Commissioner for Data Protection and Freedom of Information (BfDI) (www.bfdi.bund.de). The North Rhine-Westphalia Commissioner for Data Protection and Freedom of Information (LDI NRW) (www.ldi.nrw.de) is the relevant authority in NRW. How long and where will you keep my data?
We process and store your Personal Data only for the period of time required to achieve the respective processing purpose or for as long as a legal retention period exists, in particular commercial and tax law in accordance with Germany's Commercial Law and Fiscal Code, as applicable. Once the purpose has been achieved or the retention period has expired, the corresponding data is routinely deleted.

In general, your data is saved and stored using our in-house servers. In addition, for optimal data management and support, we store the data related to your contract with us in our proprietary backend.

What Personal Data do we process?
Technical Data
When you access our website, some access data is recorded automatically and stored in a log file on our website's server. Hosting of our website
We use the hosting services of Amazon (AWS) (410 Terry Ave N, Seattle 98109, WA and Marcel-Breuer-Straße 12, 80807 München, Germany), for the purpose of hosting and displaying our website. AWS does so on the basis of processing on our behalf, and that also means that all data collected on our website is processed on AWS' servers. The basis for processing is our legitimate interest, and the initiation and/or fulfillment of a contract.

Content Management System
We use the Content Management System (CMS) of WordPress by Automattic Inc (60 29th Street Suite 343 San Francisco, CA 94107 US), to publish and maintain the created and edited content and texts on our website. This means that all content and texts submitted to our website is transferred to WordPress. The legal basis for this processing is our legitimate interest.

Cookies
We use so-called cookies on our website. Cookies are pieces of information that are transmitted from our web server or third-party web servers to your web browser and stored there for later retrieval. Cookies may be small files or other types of information storage. There are different types of cookies: i) Essential Cookies. Fonts
We use Google Fonts by Google LLC (1600 Amphitheatre Parkway Mountain View, CA 94043, USA, and Google Ireland Limited Gordon House, Barrow Street, Dublin 4, Ireland) and Font Awesome of Fonticons Inc, (307 S Main St Ste 202 Bentonville, AR, 72712-9214 United States), on our website to display external fonts. To enable the display of certain fonts on our website, a connection to a Google/Font Awesome server is established when our website is accessed. The connection to Google/Font Awesome established when you call up our website enables Google/Font Awesome to determine which website sent your request and to which IP address the display of the font is to be transmitted. reCAPTCHA
We also use Google's reCAPTCHA from Google LLC to check whether data input is made by a human being or by an automated program. Contacting us
You can contact us in various ways and data is always collected in the process. You provide us with most of the data that we process when you contact us such as your name, and email address. This data is collected and processed exclusively for the purpose of contacting you and processing your request and then deleted again, provided that there is no legal obligation to retain it.

Booking a QHHT® Session
We process various data as part of the provision of our QHHT® Sessions bookings and for the initiation and fulfillment of the contractual relationship between you and us. If you have commissioned us to provide a QHHT® Session, we process your data (if provided: Name, contact details (email address and telephone number), home address, year of birth) and all booking information required as part of the fulfillment of the services exclusively for the purpose of processing and handling the contractual relationship.

Payment Data
If you make a purchase your payment will be processed via our payment service provider PayPal (PayPal (Europe) S. à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg). Payment data will solely be processed through PayPal and we have no access to any Payment Data you may submit. The legal basis for the provision of a payment system is the establishment and implementation of the contract.

Administration, financial accounting, office organization, contact management
We process data within the scope of administrative tasks as well as organization of our business, financial accounting, and compliance with legal obligations, such as archiving. In doing so, we process the same data that we process in the context of providing our contractual services. The purpose and our interest in the processing lies in the administration, financial accounting, office organization, archiving of data, i.e., tasks that serve the maintenance of our business activities, performance of our tasks and provision of our services.

Data Sharing
Within Merge, those who have access to your information are those who need it to fulfill our contractual and legal obligations.

Processors used by us may also receive data for these purposes. These are companies in the areas of IT services, telecommunications, and sales and marketing. If we use processors to provide our services, we take appropriate legal precautions and corresponding technical and organizational measures to ensure the protection of Personal Data in accordance with the relevant legal provisions.

Data is only passed on to third parties within the framework of the legal provisions. We only pass on user data to third parties if this is necessary, for example, for contractual purposes or due to legitimate interests in the economic and effective operation of our company including the sale of our business, or if you have consented to the transfer of data.
